hello and welcome to Washington State,Archives video on how to transfer,Superior Court case files using archive,this when you first get set up with an,archive this account we will provide you,with the login credential and a link to,archive this application you wont want,to bookmark this link for future,transfer simply click the download,button to install archive this if you,are prompted to install the application,please go ahead and do so as this will,ensure that you have the latest update,enter your login credentials in the,appropriate field archive this offers,the option of remembering your password,however please note the best practice,for security purposes is to enter your,credentials at the time you log in click,the login button and this will take you,to the data format screen on the choose,your data format screen click the,drop-down arrow and select your,recording system name for this,demonstration we will select Odyssey,data format when I asked you if your,records are from the holdings of the,Washington State Archives,please select no and click the next,button on the bottom right corner of the,screen on the what are you sending us,screen the record creator the custodial,partner and the submitting partner will,automatically be populated for you in,this demonstration we have Columbia,County Clerk selected please enter the,start date and end date to reflect a,date range of the records you are,submitting click the next button on the,where are your file screen click the,Browse button and identify where the,metadata file in comma separated value,or CSV format is located make sure that,the checkbox next to find files using,path given an input file is checked,normally your metadata will include the,path to your images however if your,metadata does,include this information you may uncheck,the checkbox and click browse to,identify where your images are located,click Next,the next screen preparing your data well,run a validation check on the records,that youve selected it checks for,duplicate entries missing metadata and,corrupt images it may take several,minutes for this validation to complete,please be patient if any errors or,inconsistencies are detected you will,see a screen like this you will need to,correct these errors before the records,can be sent,once you have corrected any errors,please rerun archive this with the same,group of records if the validation,detects no errors you will see a message,notifying you that your data has been,prepared for transfer to digital,archives please click Next to continue,this returns you to the select your data,format screen where you have the option,to prepare additional records or,transfer the ones that you have queued,select click here to transfer the data,to us and it will take you to the,transfer data to archive screen here you,will see a list of all records series,that you have prepared for transfer,select the series that you wish to,transfer or you can click select all as,long as your data is under 200 gigabytes,in size you can then click the upload to,digital archives button to transfer the,records online,if the data is 200 gigabytes or larger,please contact digital archives so that,we can ship you an external hard drive,for these larger transfer you would,select the export to hard drive button,and then ship the hard drive back to,digital archives once the transfer is,complete all of the record series will,be removed from the queue when the,upload has completed at this point if,you have no further records to transfer,you may close out of archive this by,clicking on the red X located at the top,right corner for each record series you,upload you will receive two email,notifications the first email is called,the incoming dated validation report it,lets you know that the digital archives,have received your data but has not yet,processed the records the second email,ingests a data report lets you know that,the records have been successfully,preserved in the digital archive system,and includes an attached document called,the archival record transfer form your,agency will need to retain both of these,emails for the life of the agency as,evidence of the transfer this concludes,this Washington State Archives tutorial

business and law a title,search or property title search is the,process of examining public records and,retrieving documents on the history of a,piece of real property to determine,and confirm properties legal ownership,and find out what claims or liens are on,the property,then we will see what are the types are,there in title search,first one is current owner search second,one is two owner search third one is,limited search fourth one is update,search and the last one is full search,let us discuss about one by one,first we will see about what is mean by,current owner search,it is a typically a search forward from,the current ownership deed acquisition,from full value or arms length or,acceptable whole interest starting point,although that criteria can be expanded,as necessary,this title report limits research to,current ownership information and liens,affecting real property within a defined,date period,current owner title search is ideal for,foreclosure auctions pre-tax auctions,short sales by owner transactions,refinance checking for clear title,finally a title report contain all,outstanding mortgages liens and,judgments recorded against the property,and current owners,then we will see about what is mean by,two owner search,a two owner search is a search that,provides the current vesting deed and,all deeds leading back to the the deed,prior to the out of family deed,also included are copies of any open,mortgages and assignments against any,owners found any judgments and liens,against those two fbd owners and also,tax assessment and current tax,information including any delinquencies,this search is usually done for,origination of home equity transactions,short sale foreclosure auctions and,pre-tax auctions,then we will see about what is mean by,limited search,limited search is the search which is a,client requesting a portion of search,from the title search for example client,requesting please do the lien search for,the property or please do the assignment,search for the property or please do,judgment search for the property owners,like wise client will approach some,limited request to us,this kind of search request is called as,limited search,then we will see about what is mean by,update search,an update to a previously issued policy,or title search which has examined and,reported title up to a certain date,or perform the gap search between old,affected date to new affected date,which is called as update search,update search is also called as date,down search or rundown search or bring,down or bring to date,then we will see about what is mean by,full search,a full search is a search that provides,the current vesting deed and all deeds,leading back 60 years or to a developer,also included are copies of any open,mortgages and assignments against any,owners who have had ownership of the,property in the past 60 years any,judgments and liens against those same,owners and also tax assessment and,current tax information including any,delinquencies,finally a full search title report,contain all chain of title documents all,outstanding mortgages liens and,judgments recorded against the property,agreements ccnr easements map and,notices on property against the property,real property taxes and assessments,then we will discuss about difference,between commitment report and,preliminary report,preliminary report means the report,includes information on the current,ownership outstanding deed of trusts,mortgages liens easements covenants,restrictions and any defects etc,and commitment report means a commitment,for title insurance is a promulgate,forms that offers to issue a title,policy a statement of the terms and,conditions on which the title company is,willing to issue its policy,in preliminary report there is no,agreement that the buyer or lender has,to take up a policy,in commitment report there is an,agreement between title company and,buyer or lender has to take up a policy,preliminary report doesnt contain the,requirements section of the lender,commitment report contains the,requirements section of the lender loan,amount premium in case of refinance,commitment report is also called as,starter or base file,these three difference are there in,preliminary and commitment report,then we will discuss about standard,search procedures one by one,for each and every turn on Ill be taking you through the,process of a filing in the system so,that we give you an overview of the,expectation for our litigants shortly,there will be well be playing that,video for you to be able to see exactly,the steps that will be taken through the,first step in the process is the,registration what you are seeing is that,each clients need to register just just,one minute,and the screens in the font need to,I was in Jamaica,okay if we could start it from the,beginning,so Ill take you through three parts,registration filing and electronic,service so each litigant can access the,system through registration a law firm,organization or an individual so for,this demonstration we are going to look,at how a law firm can register by,providing the business registration,number then law firm name the email,address and a mobile number once you,provide those details youll be taken,through four steps and the second step,will be for the purpose of contacts well,give you your physical location and even,an alternative mobile number you will,also be required to give your user name,so that we are able to uniquely identify,you in the system you will provide your,password and confirm and lastly youll,be required to confirm all your details,that you have correctly captured it then,you proceed and submit the registration,so all your details youll confirm at,this page and you submit and youll get,a notification to activate your account,so that is the first process of getting,an account in the system which will be,using for filing so once you activate,you will log into the system with the,email address youve just provided for,provided and the password at the home,page youll see various menus you can,file a new case you can file additional,documents in an existing case so this,will also capture new cases and a dish,and existing cases you will select the,court station for now we have all in,Arabic codes listed you will select the,respective station in Nairobi their,respective,vision or co-pays category the case type,that you intend to initiate then you,will be taken through five steps of case,registration so what happens here you,need to add the parties or youre moving,to first sorry the first step we are,going to capture all the details of the,parties the other an individual or an,organization so youll enter the first,plaintiff the name of the organization,the pin number postal address and email,address a mobile number and organization,email address that is for the first,party and this process you can repeat as,many parties as required for the case so,for the purpose of this will show how to,capture one party and these are the,parties that you represent this is an,account for a law firm so once you save,the parties they will all be listed in,the system then you proceed to the,second step where you give a summary of,the case the citation the value of the,case and the summary of their case of,the prayers which you can copy from the,document and paste in the third step you,will will be asked to add the specific,documents that you intend to file so we,have prepared all the list you will just,select the specific document and the,system will be able to give you,parameters to fill that define what,document is all about once you save all,the documents they will be listed and it,will automatically calculate the fees,that is required so at this step you are,actually doing the fee assessment which,will clearly and automatically assess,the fees,that are required for that particular,kiss and you can list as many as,required in terms of the nature of your,case and you can see the total for this,case is is continued adding up currently,at seventy thousand and seventy five you,can add an an extra you can Ana a,supporting affidavit and many other,forms of documents and the amount have,already been provided in the system so,it will just automatically calculate so,the final fee here is seventy thousand,and eighty five you can now proceed and,upload the document for each area you,have selected in terms of assessment so,you upload your PDF documents that you,will have prepared earlier so that you,just upload in the system and you,proceed ensure that each category of the,fee assessed has a document once you,upload all the documents you now preview,your case your submission before you,click on submit it will ask you to,confirm and you will submit and you will,be presented with an invoice this is the,invoice that we expected to pay it will,show you the court the name of the firm,the pay bill number they account and,they did and youll pay attention to the,reference number which will be a payment,reference number that you can that you,will use to make payments over at the,bank or at using m-pesa so once you,confirm all the details are correct you,can if you have time if you dont have,the money you can download and go and,get money and pay if you have the money,at hand you can confirm and click on pay,once you click on pay you will be able,to see the payment options that are,available you can pay by a direct and,peso,you can pay by KC,and the kcb bunk even by tella,or our agents so all these payment,options will will continue adding them,for convenience of our clans so once you,make the payment the system will check,and automatically generate a case number,automatically send your receipt that,youre able to download and view now,that you have a case number you can see,it is e2 11 you can download your,receipt and we can even go ahead and,view the case details so that is the,process of filing so that is your your,payment receipt that you can see on the,system and you can actually download it,if you want to continue reviewing the,case you can check all the documents,that you have that have been submitted,and you now can start the process of,electronic service so that is the,process for filing that we have that,represented today this is an overview,there are more details that you can come in,stand here as they load the next,good afternoon everybody Ill take you,through our processes in terms of our,case management I learn on your toll,that youve already developed our own,case management system so just like the,judiciary we also have to log in so how,to log in and each and every officer has,been given an a very a unique,identification number and also they have,to get in through using a password so,our basis is basically starts from the,time you receive a file from the,investigating agency so you can see now,we are receiving a file from one of the,investigating agency and then once the,file has been received then you may call,the recording you capture all the data,from which agency is it coming from,which institution who has brought it you,put you try and collect all the,information that is required then,thereafter you put what is called a QR,code you can see now we put in the QR,codes and after putting in the QR codes,now you move into the stadium scanning,and indexing all the details in the file,so there you go weve scanned and put in,the details then you move it to the next,step which you call screaming all these,words once received theyll come into a,pool where they are now screened and,allocated to different offices you can,see theyve been allocated to different,offices here and then once the officers,have received the first then now welcome to our 48 webinar for the health,Im an accidental government information,librarian series Im really excited,today to have Jennifer Behrens talk,about court records Jennifer has done,one of these before for us and Im very,excited to have her back Jennifer is the,head of reference services and a,lecturing fellow at Duke Law Schools,Jay Michael Goodson law library where,she provides regular instruction on,legal research topics jennifer holds,with a JD and an MLS from the University,of Buffalo and previously worked as a,graduate assistant in the UBS,Charles B Sears Law Library as well as,its Lockwood as well as Lockwood,librarys former business government,documents Reference Center she served as,secretary treasurer of NCUAs,government resources section from 2009,to 2011 thank you very much Jennifer,well thank you Linda and thanks to all,of you for being here I cannot believe,its been more than two years since my,last webinar for MCLA on basic legal,research if you are here for that one,thanks for coming back and I want to,assure you that there wont be a lot of,overlap today I think theres maybe two,or three slides that overlap a little,bit since in that webinar we focused a,lot on locating legal precedent or,primary law rather than these sorts of,background materials from the original,lawsuit or the trial that lead to,eventually a court opinion that might be,legal precedent or primary law so heres,my plan for today Im drawing a dividing,line between recent and historical cases,which is a little bit arbitrary and Ill,move it periodically just to warn you,roughly you know early 2000s is a good,cutoff point and the methods that youll,use for both recent and historical case,research are pretty similar but the,sources will be different the older the,farther back you go so I know in my,library we are asked to locate court,filings and other case materials from,all different eras quite a bit and if,youre here today I suspect that you are,too and patrons could have any number of,reasons for wanting this information,other could be academic purposes to,write a paper for the background on a,particular trial that theyre,researching for a paper,genealogy is probably a pretty big one,that those of you in public and general,academic libraries deal with people,looking at their ancestors who were,parties to a court case whenever that,happened or it could be something that,the the patron is personally involved in,or just emotionally invested in,something thats having an environmental,impact in their neighborhood and they,want to track whats going on with a,pending case so any number of reasons,you can probably think of more but just,keep that in mind its a pretty wide,variety of questions that you might get,and even for people who do this type of,research all the time every question is,a little different and knowing where to,go and what to look for it can be really,confusing so just to outline some of the,terminology Ill be using today I think,most researchers will probably want to,obtain or review the cases docket which,will be a chronological list of activity,thats going on in a particular legal,proceeding for proceedings that never go,beyond a trial level court they may want,to get a hold of the documents that were,filed in that lawsuit or legal,proceedings such as the complaint that,kicks off a civil lawsuit or the,criminal indictment at the start of a,criminal case if a case ends up being,appealed from the trial court then,youll get some briefs that are filed by,both sides basically laying out the,their argument and what they think that,appellate court should do about the,outcome of that trial case there might,also be briefs from interested third,parties the appellate court will also be,sent selected items from the lower court,which is known as the record on appeal,or they sometimes the appendix and those,can all be really helpful documents to,look at and for both trial and appellate,level cases transcripts of the,proceedings might be available theyre a,little bit easier to find at the,appellate level than they are for trials,but you can get them in both cases well,talk a little bit more about that today,so there is also some bad news here your,users could also find out that something,has been sealed by the court and is,going to be a little bit tougher to get,if youre able to petition them to,unseal it great but it could be a tough,road,the,it could also have destroyed the records,either as part of its disposal plan or,they might have been destroyed by fire,flood all the natural enemies of,archives some materials just arent,going to be available online as another,bad news that your patrons might hear or,if they are they might cost money to,access this is where you really sort out,whos serious about this kind of,research and whos just sort of curious,these are pretty common in this type of,research theres absolutely no guarantee,even though theyre public records that,these materials are going to be free,these are very very common and theres,also no guarantee that things will be,available in the exact format that,somebody wants particularly with,transcripts audio recordings are fairly,common if people would like to hear the,actual audio thats not too hard to get,written down transcripts pretty,obtainable video is a little bit rarer,and video from the US Supreme Court is,absolutely non-existent thats sort of,like the proverbial photograph of Jesus,reference question its just that thing,that everyone thinks exists but doesnt,exist but for the most part I think,something will be available online that,will help you or your user get started,but the next steps are going to be,determined by several factors about the,legal action that youre researching,number one whether youre in federal or,state court number two whether the court,is the trial or the appellate level and,number three how old the proceeding was,that youre trying to research and its,essential with this kind of research to,keep your courts and your court system,straight so in the United States we have,separate but sort of parallel running,systems of federal and state courts the,structures are similar,most of these jurisdictions involve a,lower trial court system and then two,levels of appellate courts an,intermediate appellate court and a court,of last resort not all states have that,intermediate appellate court sometimes,it just goes straight to the the court,of last resort and the same kinds of,courts are called different things in,different jurisdictions this is where it,can get kind of tricky Ive listed the,most typical terminology that youll run,across here on the screen but just to,give you one,notable variation in the state of New,York the Supreme Court is the trial,court for some reason I dont quite know,why and the Court of Appeals is the,court of last resort so you cant really,assume what level of court youre,dealing with its really important to do,a little bit of research into your,jurisdictions court structure before you,start digging in because itll save you,some time and frustration down the line,okay so lets talk about other,background information that you should,have from the very beginning ideally,youve probably heard of the five Ws,from from journalism school theyre,pretty applicable here too so for the,who hopefully you or your patrons should,know a name or two most likely the,parties that are involved possibly,attorneys and judges could be useful in,narrowing down a case if your parties,have particularly common names keep in,mind when youre dealing with parties to,a lawsuit that sometimes cases will,involve multiple sets of parties that,get consolidated parties might also drop,off of the case after a settlement or a,dismissal that affects only them and not,the other parties so be prepared when,youre doing the research that the,formal case name you know plaintiff,versus defendant Smith v Jones whatever,might not match your party name exactly,but they could still be a party to that,case

related to this webinar so,this webinar is for the purpose of,teaching about ediscovery so the first,thing we are going to talk about when it,comes to ediscovery is creating,discovery packets and managing discovery,in just where and how that all works and,then were going to approach discovery,from the Justice web side of just where,and if you dont have justice web it is,an additional add-on you can buy for,just where which gives public access to,just wear and its very configurable and,it is based off of case involvements so,depending on whos involved on the case,can see different things and well dive,into all that as we go along here youll,also notice that we have some open chat,that were doing during this webinar so,if you have specific questions as I am,going through my demonstration feel free,to either ask those questions via chat,or if youre watching this video later,feel free to email those questions in to,support and we will answer those as soon,as we can alright so what I have is my,just were here the first thing Im,going to talk about is discovery how do,you create discovery quote-unquote in,just where and obviously discovery is,pretty broad Ive been talking to a lot,of different agencies on what discovery,means and how you have been handling,your discovery in your office discovery,can mean burning a CD and handing it to,someone it can mean printing off some,documents and sending it to someone in,the mail,when it comes to e-discovery we want to,do things electronically so either,delivering your discovery via email or,in our case today delivering it via,justice web and well talk about all,these different options as we go along,here in order to set up discovery the,first prerequisite is to have a,discovery packet or file packet created,in your system administration so Im,going to click on system administration,Im going to go to my co tables and Im,going to go to jda applications and,documents and under my documents here,youll see that there are a couple,different document types as you may be,familiar with under are types over here,we have a type of number five which is,file packet this is pre-wet prerequisite,number one which is you need to have a,file type of file packet number five a,document type of file packet notice Ive,got to Ive created in here one called,medical packet one called discovery,packet these are basically folders that,you are going to be putting your,discovery into and you can name them,whatever you want and youll see as we,go through the demonstration how they,correlate here so we need to have the,type of file packet at least one type so,if you want just one called discovery,packet to start off with go ahead and,create one of those make sure its set,to number five nothing else really needs,to be set up here the next thing you,need is to set up documents as read only,in terms of being able to put those into,your discovery packets when it comes to,read only documents that means that when,theyre saved they can only be opened,and read only they cant be edited after,that so if I scroll over to the right,here I can actually drag it over and Im,actually working in just where 5 10 so a,few of these options have changed with,the revamp of our filing cabinet we have,a column in here that is a read-only,column in previous versions of just,where you had the option to say never,lock lock and unlock or,always lock so this replaces that column,where you youre basically saying its,either locked or its unlocked and in,the new filing cabinet everything is set,up to be lock and unlock so its a lot,more secure or or much less probability,of errors there so it also has to be,marked as read only so Im actually,going to drag these columns over you to,the left so weve got some screen real,estate here all right so Ive got my,discovery packet its a file packet and,its marked as read only now um you need,discovery to go in those anything that,is marked as read only so documented,case discovery document notice that has,the word discovery in it initial,discovery pricing anything that you want,to lock or anything you want in your,discovery packet needs to be marked as,read only in order to go into the,discovery packet and youll see on that,coming up here alright so thats the,prerequisite for creating a discovery,packet you have to have a file packet,and you have to have locked or read-only,documents so Im going to close out of,assistive ministration since Ive got my,prerequisites mainly were going to be,working with police car videos and mug,shots today and now this mug shot is not,read only and youll see why here in in,a second alright so weve weve met,prerequisite number one we have a file,packet and we have documents that are,set to be read only our case were going,to be working on today is yogi the bear,so Im gonna do a search for yogi here,yogi the bear fighting the honey badger,I can open up his case in tab details,view all right and then were right in,the filing cabinet of his case so the,first thing in terms of creating,discovery is documents have to be in the,just war filing cabinet there is no,other way from a just and point to,manage your discovery than inside of,just where that means if you have,another file share somewhere else and,you want to,send discovery from there through,justice web those files have to be in,the Jets were filing cabinet in order to,manage them with justice web so Im,going to add a document here were going,to add a police car video remember that,one was already set for read-only I,dont have any real police car videos so,Im just going to grab a JPEG of yogi,the bear off my desktop the filing,cabinet can hold any files any file,types that you have on your computer so,yogi the bear and hit save so now we,have the yogi the bear file in here and,remember this one is read-only so and,pictures you know theyre pretty much,always read only but since this one is,marked as read only we can put it into a,a discovery packet if we add one that is,not read only such as mugshot so heres,yogi again mugshot does not read only,and so it will not allow us to put that,into a discovery packet so lets open up,another view here its called the,discovery packet view this is the view,that you can use to create discovery,packets so Im going to click on,discovery packets now weve got two,views open we have our tab details view,and we have our discovery packets view,and if you find that youre making,discovery packets pretty frequently you,can actually take this snap in and stick,it into your tab details view and that,would be done either by someone in your,office that knows how to create new,screens or you can just call in to,support and we can help put the,discovery packet snapping into your tab,details view so in our discovery packet,view lets go ahead and create a,discovery packet and lets talk about,the columns we have here our document,types are those to file packet types,that we set up in system administration,so,if you recall the first prerequisite was,to make a file packet these are the two,options we have either a discovery,packet or a medical packet so were,going to pick discovery packet you give,it a title so we can say this is a,Yogis yo DS like Yoda Yogis police,video you can select compression so this,means if you want it to be password,protected and encrypted were going to,leave these webs unencrypted for now,that we will make one that is compressed,so that you can see how that works,request type activation date and,expiration date all have to do with,justice web so we will
